Supreme Court Dismisses Ex-RG Kar Principal's Plea Against CBI Probe in Corruption Case

Sandip Ghosh's plea challenging the Calcutta High Court's order for a CBI investigation into corruption is rejected.

The apex court has recently thrown out the petition filed by Sandip Ghosh, the former principal of RG Kar Medical College challenging the Calcutta High Court that transferred a corruption case against him to CBI. The bench, comprised of Chief Justice DY Chandrachud, JB Pardiwala, and Manoj Misra also reject a prayer of Ghosh, to be impleaded as an original respondent to PIL pertaining to financial embezzlement while overseeing the institution. 

 

 The court said that being an accused Ghosh does not have legal right to interfere in the PIL which is being monitored by Calcutta High Court. Further, the Supreme Court declined to strike out the comments made by the High Court to associate the alleged financial crisis with the rape and murder of a trainee doctor in hospital on 9th August. 

 

 Ghosh had been principal of the state-run hospital since 2021, but he took sabbatical later for a few months. The sitting of the High Court was to order for a transfer of the investigation to CBI on August 23, following allegations given by Dr. Akhtar Ali, a former deputy superintendent of the involved police department, saying that there were some embezzlements of finances during the time that Ghosh was serving. 

 

 Ghosh was arrested by CBI after he was grilled several times by the agency. He said in his Supreme Court petition that the Calcutta High Court never gave him a chance to explain before it ordered the CBI probe, a grievance of natural justice.
