Supreme Court Grants Interim Bail to Delhi CM Arvind Kejriwal in Excise Policy Case

The Supreme Court of India gave an interim bail to Delhi Chief Minister, and AAP National Convenor, Arvind Kejriwal on Thursday. The senior advocate for Kejriwal, Abhishek Manu Singhvi explained to the court that the app is not a threat to the society. The Delhi High Court was listening to the petition arguing against CBI arrest of AAP leader and Delhi CM, Arvind Kejriwal in connection with Delhi excise policy case, where Kejriwal has been named a main conspirator. 

 

 The fourth supplementary chargesheet was filed by the CBI on July 30, AAP members including Kejriwal was named in the chargesheet which accused him of being a part of the said conspiracy. Vivek Singhvi referred to the argument of Kejriwal that he has not been named in the first information report filed in the case and said there was no fresh evidence than the facts exposed in January apart from the statement of Magunta. 

 

 Singhvi went further to condemn Kejriwal arrest when in judicial custody arguing that the arrest was done without coming up with new charges. Therefore, there is no harsh word to trouble Kejriwal as well as, he underlined that Kejriwal is a constitutional functionary and he is not a flight risk let alone one to tamper with evidence or influence witnesses. 

 

 The Supreme Court was also critical of the CBI pointing out that arresting someone in custody is possible only with the court’s permission. According to Singhvi, certain measures should be put in place in such circumstances as the arrest should not be made without probable cause. The Delhi High Court in extending Kejriwal’s judicial custody has from August 14 meaning that he might linger behind bars till at least the middle of September, depending on the final outcome therefore, the appropriate motion is denied with Kejriwal held until September 11th.
